The Control of Asbestos Regulations 2012 created a legal duty for the owner/controller of buildings to manage asbestos and its risks. If asbestos containing materials (ACM) are present, or thought to be present, then it needs to be appropriately managed. This involves keeping an up-to-date record of the location and condition ACMs present in the building and preparing a management plan that details how the risk posed by the ACMs will be appropriately managed.
Initially an asbestos management survey should be carried out, if one has not already been carried out, to ascertain:
- The location of any suspected ACMs
- The extent of said ACMs
- The type of asbestos in the ACMs
- The condition of the ACMs and if they could be damaged during normal occupancy, including by foreseeable maintenance and installation
The survey’s findings get published in an asbestos survey report, along with appropriate recommendations. The survey report should then be used to prepare an asbestos register, sometimes called an asbestos risk register.
Asbestos Register Requirements
The asbestos register should be updated at least annually, and needs to be available to anyone who plans maintenance and any related work, so they can consult it before any work is organised.
The asbestos register should detail:
- Location of the ACM
- Type of ACM
- Quantity of ACM
- Presence of surface coating
- Condition of ACM
- Ease of access
- Type of asbestos
- Score for the ACM
- Priority score
- Other comments
